Terms of Service
Last updated: 26 May 2026
These Terms of Service ("Terms") govern your use of Blyss, a digital marketplace operated by Blyss Limited ("Blyss", "we", "us") from Nairobi, Kenya. By creating an account, listing a product, or making a purchase, you agree to these Terms.
If you don't agree, don't use Blyss.
1. Who can use Blyss
You must be at least 18 years old, or the age of majority in your country, whichever is greater. By using Blyss you confirm you meet this requirement.
If you sign up on behalf of an organization, you confirm you have authority to bind that organization to these Terms.
We may refuse service, suspend accounts, or remove content at our discretion if we believe you've violated these Terms or any applicable law.
2. The Blyss platform
Blyss is a marketplace where independent creators (we call them "Sellers") list and sell digital products to buyers (we call them "Buyers"). Blyss provides hosting, checkout, payment processing, and payout infrastructure. Blyss does not own, create, or sell the products listed on the platform — Sellers do.
When a Buyer purchases from a Seller on Blyss, the contract for the product is between the Buyer and the Seller. Blyss is the payment facilitator and platform host.
3. Seller agreement
By listing a product on Blyss, you (the Seller):
- Own the rights to everything you sell, including any included assets, fonts, code, music, or imagery. You grant Blyss a limited, worldwide, non-exclusive license to host, display, and distribute your products to the buyers you sell to.
- Pay a 12% platform fee on each completed sale, deducted automatically before payout. Paystack/M-Pesa processing fees are passed through at cost.
- Receive payouts to your linked Paystack subaccount on a rolling basis. Payouts settle to your Kenyan bank or M-Pesa within 24–72 hours of a verified, non-disputed sale.
- Honour your descriptions. What you describe in your listing is what Buyers expect to receive. Misleading descriptions may result in refunds, listing removal, or account closure.
- Respond to Buyer questions in a reasonable time and address legitimate complaints.
- Comply with our Acceptable Use Policy. This is the most important section — read it.
4. Buyer agreement
By purchasing on Blyss, you (the Buyer):
- Agree that all sales are final at the point of delivery, except where our Refunds Policy specifically applies (broken downloads, undelivered files, or material misrepresentation).
- Agree not to redistribute, resell, or share the digital products you purchase unless the Seller's licence explicitly allows it.
- Agree that the Seller (not Blyss) is responsible for the product itself — including its quality, accuracy, and fitness for your intended use.
- Agree that chargebacks and disputes will be reviewed by Blyss in good faith and may result in payout reversals from the Seller's account.
5. Payments and payouts
Payments on Blyss are processed via Paystack (card payments) and M-Pesa (mobile money). All transactions are denominated in Kenyan Shillings (KES) by default, with USD support for cross-border sales.
Sellers must complete identity verification (KYC) and link a Paystack subaccount before receiving payouts. Verification may include providing a national ID, business registration documents, and a phone number.
6. Account suspension and termination
We may suspend or terminate your account if:
- You materially breach these Terms or our Acceptable Use Policy.
- We're required to by law, regulator, or payment processor.
- You repeatedly receive valid complaints, refund requests, or chargebacks above industry-standard thresholds.
We'll notify you of suspensions and give you a reasonable opportunity to respond, except where law or fraud risk requires immediate action.
You can close your account at any time from your dashboard settings. Pending payouts settle to your linked account and your products are removed from sale. Existing Buyer access to already-purchased products continues for as long as we can reasonably support it.
7. Intellectual property and DMCA-style takedowns
If you believe content on Blyss infringes your copyright, trademark, or other rights, email [email protected] with: a description of the work, the URL of the infringing listing, your contact information, and a statement made in good faith. We respond to verified takedown requests within 5 business days.
Sellers who repeatedly receive valid takedown notices will have their accounts terminated.
8. Limitation of liability
To the maximum extent permitted by Kenyan law, Blyss is not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or business interruption arising from your use of the platform.
Our aggregate liability to you for any claim arising under these Terms is limited to the greater of: the total platform fees you paid Blyss in the 12 months prior to the claim, or KES 50,000.
This section does not limit liability that cannot be limited under applicable law.
9. Changes to these Terms
We may update these Terms occasionally. Material changes will be announced by email and on the website at least 14 days before they take effect. Continued use of Blyss after changes take effect means you accept the new Terms.
10. Governing law and disputes
These Terms are governed by the laws of Kenya. Any dispute arising from your use of Blyss is subject to the exclusive jurisdiction of the courts of Nairobi, Kenya.
If you have a problem, please email [email protected] before escalating — we'd much rather solve it than litigate it.
